Object:

This contract concerning the sale of goods is concluded between the seller (hereinafter referred to as Anne Robin) and a buyer (hereinafter referred to as the Customer), within the framework of a distance selling system.

Scope:

These general conditions of sale concern sales made by Anne Robin on her website (Anne Robin acrylic paints / annerobin.wixsite.com).

Any order placed with Anne Robin Paints Acrylics implies express and unreserved acceptance of these general conditions of sale.

In addition, the Customer declares to be at least 18 years old and to have the legal capacity or to hold parental authorization or guardianship allowing him to place an order on the Anne Robin acrylic paints website.

These general conditions of sale are likely to be supplemented by special conditions, stated on the support before any transaction with the Customer.

Applicable law:

These general conditions of sale as well as the prices are expressly approved and accepted by the customer, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to invoke any contradictory document and, in particular, his own conditions. general conditions of purchase, the act of purchase entailing acceptance of these general conditions of sale. Price and shipping costs:  

The prices indicated on the website, by e-mail or during the various advertising operations of Anne Robin are given without obligation and are subject to change in the event of a product update. The prices, established net in euros (VAT not applicable: article 293B of the general tax code), are those in force at the time of the order. If, for any reason whatsoever, an incorrect price is indicated to the customer when ordering, only the price in force will prevail; in this case, the customer will have the option of canceling his order.

The prices indicated are for Europe. For other destinations, please contact Anne Robin. They will be added and reported before the time of ordering. The prices indicated will be those in force for registered shipments from the Post Office or other carrier. They will also include the packaging costs.

For paintings shipped outside the European Union, customs or import taxes or VAT may be eligible. These rights and sums are not the responsibility of Anne Robin. They will be borne by the Customer and are the sole responsibility of the customer both in terms of declarations and payments to the competent authorities and bodies of the country concerned.

Ordered:

Anne Robin sends immediately after the order agreement a confirmation email to the customer. This email includes the specifications of the order, its total amount, billing and delivery addresses. The order is accepted by Anne Robin when it has been confirmed by the customer in writing and the payment has been validated by Anne Robin.

In the case of payment by credit card or bank transfer, the validation of the payment means that our banking partner has confirmed the payment.

In the case of payment by check, validation of the payment means that the check has been received and cashed by Anne Robin.

The shipment of items is only effective after acceptance of the order by Anne Robin.

Termination:

Anne Robin reserves the right not to record a payment and therefore not to accept an order for any reason whatsoever relating in particular to a supply or delivery problem foreseeable at the time of the order.

The Customer will be informed by email - sent to the email address he entered when ordering with Anne Robin, within seven working days of the order. Non-execution or partial execution of an order will not give rise to any right to compensation. In such a case, no payment will be collected by Anne Robin.

 

Payment terms:

Payment is made in full when ordering, in cash, without discount and at the net price in euros only.

The accepted payment methods are:

-payment by check from a French bank, validation of payment means that the check has been received and cashed by Anne Robin.

-By bank transfer to Anne Robin's bank account, whose details will appear in the order acknowledgment.

Bank charges related to payment by using one or other of these payment methods are the responsibility of the customer.

Collection of payments:

The debit on the Customer's bank card will be made in euros at the time of the order.

In case of payment by bank transfer, the collection is made on the day of the transfer.

In the event of any payment incident, Anne Robin reserves the right to suspend current orders and to refuse to honor any new order until full payment of the amounts due.

Once the order has been validated in writing by both parties, the customer has 5 working days to send payment in any form whatsoever. After this period, Anne Robin reserves the right to cancel the order.

Delivery:

Anne Robin undertakes, in the event of acceptance of an order, to sell and ship to the address indicated by the customer, the products chosen by him during the order within a maximum period of two weeks, except in the case of prolonged absence for vacation or business travel, In which case the customer will be notified before placing his order, and if it has already been placed, he may enjoy his right of immediate withdrawal.

To this period, must be added the delivery time of the carrier.

Packages are sent by post or by another carrier of the choice of Anne Robin acrylic paints. Delivery times are those indicated by the carriers. Anne Robin can in no way be held responsible for delays in delivery times. Any delays in delivery do not entitle the buyer to claim damages.

Anne Robin acrylic paints delivers to the delivery address indicated by the Customer when entering his order on the Anne robin acrylic paints website or indicated by email by the customer. The information given by the customer when ordering commits the latter: in the event of an error in the wording of the recipient's contact details, Anne Robin cannot be held responsible for the impossibility in which he may find himself, to deliver the product.

Although Anne Robin takes the greatest care in the packaging of her works, the goods sold travel at the risk and peril of the customer to whom it will be up to verify the conformity and the number of shipments received and to expedite, if necessary, against the carrier, in particular in the event of damage, substitution or shortage, the procedures provided for in Articles 105 et seq. of the Commercial Code.

The customer must verify the conformity of the goods delivered at the time of delivery and before signing the carrier's delivery note. In the event of a dispute at the time of delivery of the package, the recipient will make reservations to the carrier on the delivery slip. This dispute must be declared by means of a letter with acknowledgment of receipt sent to Anne Robin, within 48 hours (working days).

In the event of non-delivery of an order or part of an order, the Customer has a maximum of three months from the date of shipment to report to Anne Robin. Beyond this period, Anne Robin will not accept any complaint.

Transfer of ownership:

The seller retains full ownership of the products sold until full payment of the amount of the order. However, upon delivery, the risk of loss or damage is transferred to the buyer.

Withdrawal:

Buyers, non-professional natural persons, benefit from a withdrawal period of fourteen days from the delivery of their order to return the product to the seller for exchange or refund without penalty, with the exception of return costs.

Guarantee:

The Customer benefits from the provisions of the legal guarantee against hidden defects provided for by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or reimburse it. All complaints, requests for exchange or refund must be made by email to the following address: anne_robin@hotmail.fr within seven days of delivery.

The products sold on the Anne Robin acrylic paints site are not subject to any additional guarantee from Anne Robin. They will not be returned or exchanged.

Confidentiality:

Anne Robin treats all information concerning the Client with the strictest confidentiality. In the absence of explicit and written authorization issued by Anne Robin, the Customer refrains from reselling the products sold by Anne Robin. Under the same conditions, he refrains from reproducing in any way and on any medium whatsoever, in particular digital, the visuals or images sold on the Anne Robin site acrylic paints.

Any order placed by a Customer is for his personal use or for the personal use of the person in whose name the delivery is to be made. In the latter case, the Customer guarantees the personal acceptance of these General Conditions of Sale by the recipient of the delivery.

Force majeure:

Are considered as force majeure which releases Anne Robin from any obligation to honor a Client's order, strikes, civil or foreign war, riots, acts of terrorism, total or partial destruction of premises or other , disruptions in transport, supply difficulties, customs measures of any nature or origin whatsoever, or any other fortuitous event which prevents or delays totally or partially the performance of Anne Robin's obligations.

Disputes:

The conditions of sale are governed by French law. In the event that a dispute arises from this contractual relationship, the parties undertake before any legal action to seek an amicable solution.

In the event of a dispute, the Tribunal de Grande Instance of Evry has sole jurisdiction.
